1. INTRODUCTION AND WHO WE ARE

ClimateAi, Inc. (“ClimateAi,” “we,” “us,” or “our”) is an AI-powered climate intelligence company headquartered in the United States. We provide the ClimateLens™ platform and related services that help businesses in food, agriculture, finance, and other sectors build climate resilience.

This Privacy Policy explains how ClimateAi collects, uses, discloses, and protects personal information obtained through our website at climate.ai, our web-based applications (including ClimateLens™ Monitor, ClimateLens™ Adapt, and LensConnect™ API), and any other services we operate (collectively, the “Services”).

Data Controller: For purposes of the EU General Data Protection Regulation (GDPR), ClimateAi, Inc. acts as the data controller of personal data collected through the Services.

2. SCOPE AND APPLICABILITY

This Privacy Policy applies to:

Visitors to climate.ai and any ClimateAi subdomain
Users who register for or use the ClimateLens™ platform or LensConnect™ API
Individuals who contact us for support, sales inquiries, or via our contact forms
Job applicants and potential partners

This policy applies regardless of where you are located. If you are located in the European Economic Area (EEA), the United Kingdom, or Switzerland, additional rights and protections apply to you under the GDPR and related laws. If you are a California resident, additional rights apply under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).

This policy does not apply to personal information we process on behalf of our enterprise customers in our capacity as a data processor. Such processing is governed by the relevant Data Processing Agreement.

3. PERSONAL INFORMATION WE COLLECT

We collect personal information in the following categories:

3.1 Information You Provide Directly
  • Account & Registration: Account and registration data
    Name, business email address, job title, company name, and password when you create an account or request access to our platform.
  • Inquiry & Contact: Inquiry and contact data Information you submit via contact forms, demo requests, or email, including your name, email, phone number, company, and the content of your message.
  • Newsletter & Subscriptions: Subscription and newsletter data Email address and communication preferences when you subscribe to our blog, podcast, or marketing communications.
  • Gated Content: Downloadable content requests Name, email, company, and role when you request whitepapers, reports, or other downloadable resources.
  • Job Applications: Career application data Resume/CV, cover letter, work history, and other information provided through our careers page.
3.2 Information We Collect Automatically

When you visit our website or use our Services, we automatically collect:

  • Usage data: IP address, browser type and version, operating system, device type, referring URLs, pages visited, time spent on pages, links clicked, and navigation paths.
  • Log data: Server logs recording access times, request types, and error events.
  • Cookie and tracking data: Identifiers placed by cookies, pixels, and similar technologies (see Section 8, Cookie Policy, for full details).
  • Platform usage analytics: Feature interactions, query patterns, dashboard configurations, and API call metadata within the ClimateLens™ platform (used to improve the product and for account administration).
3.3 Information We Receive from Third Parties
  • Business intelligence enrichment data from providers such as LinkedIn or Clearbit to supplement contact information.
  • Analytics data from Google Analytics and Google Tag Manager.
  • Event and webinar attendance data from platforms we use to host events.
3.4 Sensitive Personal Information

ClimateAi does not intentionally collect sensitive personal information (such as Social Security numbers, financial account credentials, health data, precise geolocation, racial or ethnic origin, or biometric data) through its public website. If any such information is inadvertently submitted, please contact us at media@climate.ai and we will promptly delete it.

4. LEGAL BASES FOR PROCESSING (EEA, UK, and SWITZERLAND USERS) 

Under the GDPR and applicable national laws, we process your personal data on the following legal bases:

  • Contract: Performance of a Contract (Article 6(1)(b) GDPR):
    Processing your account data, service data, and transaction data to create and manage your account, provide the ClimateLens™ platform, fulfill our contractual obligations, and respond to service-related requests.
  • Legitimate Interests: Legitimate Interests (Article 6(1)(f) GDPR):
    Processing usage data and correspondence data to improve our website and Services, manage customer relationships, send relevant product updates to existing customers, ensure security, and defend legal claims. We balance our legitimate interests against your rights and will not process data under this basis where your interests override ours.
  • Consent: Consent (Article 6(1)(a) GDPR):
    Processing for marketing emails sent to new contacts, use of non-essential cookies and tracking technologies, and any other processing for which we have asked for your permission. You may withdraw consent at any time without affecting the lawfulness of prior processing.
  • Legal Obligation: Legal Obligation (Article 6(1)(c) GDPR):
    Processing required to comply with applicable laws, regulatory requests, court orders, or other legal obligations.
  • Vital Interests: Vital Interests (Article 6(1)(d) GDPR):
    Processing where necessary to protect the vital interests of any person in emergency situations.
5. HOW WE USE YOUR PERSONAL INFORMATION

We use the personal information we collect for the following purposes:

  • Providing and operating our Services, including the ClimateLens™ platform and LensConnect™ API
  • Creating, managing, and maintaining user accounts
  • Responding to inquiries, support requests, and feedback
  • Sending marketing and promotional communications (where legally permitted and subject to your preferences)
  • Personalizing and improving the user experience on our website and platform
  • Conducting analytics to understand how our Services are used and to develop new features
  • Ensuring the security, integrity, and availability of our Services
  • Detecting and preventing fraud, abuse, or violations of our Terms of Service
  • Complying with legal obligations and enforcing our agreements
  • Sending operational communications such as security alerts, system updates, and policy changes
6. HOW WE SHARE YOUR PERSONAL INFORMATION

We do not sell your personal information for monetary consideration. We do not share your personal information with third parties for their own direct marketing purposes without your consent. We may share your information in the following circumstances:

6.1 Service Providers and Processors

We share information with trusted third-party vendors who process data on our behalf under written agreements, including:

  • Cloud hosting and infrastructure providers (e.g., Amazon Web Services, Google Cloud)
  • Customer relationship management (CRM) platforms (e.g. HubSpot)
  • Marketing automation platforms (e.g.Hubspot)
  • Analytics providers (e.g., Google Analytics)
  • Customer support platforms (e.g., Zendesk, Intercom)
  • Video conferencing tools used for demos and onboardinG

These providers are contractually prohibited from using your information for any purpose other than providing services to us.

6.2 Business Partners

With your consent or where otherwise permitted, we may share information with authorized resellers, referral partners, or integration partners to facilitate delivery of the Services.


6.3 Legal Requirements and Protection

We may disclose information when required by law, legal process, governmental authority, or when we believe disclosure is necessary to protect rights, safety, or property — ours, yours, or others’.


6.4 Business Transfers

If ClimateAi is involved in a merger, acquisition, asset sale, financing, or bankruptcy, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on our website before your information is transferred and becomes subject to a different privacy policy.


6.5 Aggregated and De-Identified Data

We may share aggregated or de-identified information that cannot reasonably be used to identify you for industry research, product development, or other business purposes.

7. INTERNATIONAL DATA TRANSFERS

ClimateAi is headquartered in the United States. If you are located in the EEA, UK, Switzerland, or another jurisdiction outside the US, your personal data will be transferred to and processed in the United States, which may not offer the same level of data protection as your home jurisdiction.

We implement appropriate safeguards for international transfers, including:

  • Standard Contractual Clauses (SCCs) approved by the European Commission for transfers from the EEA to third countries
  • The UK International Data Transfer Agreement (IDTA) or UK Addendum to the. SCCs for transfers from the UK
  • The Swiss Standard Contractual Clauses for transfers from Switzerland

8. COOKIE POLICY AND CONSENT MANAGEMENT
8.1 What Are Cookies

Cookies are small text files placed on your device when you visit a website. Similar tracking technologies include pixel tags, web beacons, local storage, and scripts. This section covers all such technologies collectively.

8.2 Categories of Cookies We Use

Strictly Necessary Cookies
These cookies are essential for our website to function and cannot be switched off. They include session management cookies, security tokens, and load-balancing cookies. No consent is required for these cookies. Examples: PHPSESSID (session), XSRF-TOKEN (security)

Analytics & Performance Cookies
These cookies collect anonymous information about how visitors use our website. We use Google Analytics and Google Tag Manager (GTM-KT2H7BG) for this purpose. These cookies help us understand traffic sources, popular pages, and user behavior so we can improve the site. These are only set with your consent (EEA/UK visitors) or where applicable opt-out mechanisms are provided (California visitors). Examples: _ga, _gid, _gat (Google Analytics).

Functional Cookies
These cookies remember your preferences and personalize your experience (e.g., language settings, previously viewed content). They may be set with your consent or as part of our legitimate interest to provide a better experience.

Marketing & Targeting Cookies
These cookies track your browsing activity across sites to deliver relevant advertising and measure campaign effectiveness. They are only placed with your explicit consent. Examples: LinkedIn Insight Tag, Meta Pixel (if active), HubSpot analytics.

8.3 CONSENT MANAGEMENT FOR EEA, UK, AND SWISS USERS

When you first visit climate.ai from the EEA, UK, or Switzerland, you will be presented with a cookie consent banner that allows you to:

  • Accept all cookies
  • Reject all non-essential cookies
  • Customize your cookie preferences by category

Non-essential cookies (analytics, functional, and marketing cookies) will not be set until you have given your explicit, informed, and freely given consent. Strictly necessary cookies do not require consent.

You may withdraw or change your consent at any time by clicking the “Cookie Settings” link in the footer of our website.

8.4 CALIFORNIA COOKIE PREFERENCES

California residents may opt out of the “sharing” of personal information (including cookie-based data used for cross-context behavioral advertising) via the “Do Not Sell or Share My Personal Information” link in our website footer, or by enabling a Global Privacy Control (GPC) signal in your browser, which we honor as a valid opt-out request.

8.5 BROWSER CONTROLS

Regardless of location, you can control cookies through your browser settings. Most browsers allow you to block all cookies, accept only first-party cookies, or delete existing cookies. Note that blocking all cookies may impair the functionality of our website. Please refer to your browser’s help documentation for instructions.

8.6 THIRD PARTY ANALYTICS OPT-OUTS

You can opt out of Google Analytics tracking at all websites by installing the Google Analytics Opt-out Browser Add-on (available at tools.google.com/dlpage/gaoptout). You can also opt out of interest-based advertising at optout.aboutads.info or youronlinechoices.eu.

9. DATA RETENTION

We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, to comply with legal obligations, resolve disputes, and enforce our agreements. Our general retention periods are:

  • Account data: Retained for the duration of your account plus 3 years after account closure, or as required by applicable law.
  • Usage and analytics data: Retained for up to 26 months in analytics systems (per
  • Google Analytics default settings, configurable).
  • Contact and inquiry data: Retained for 3 years from last interaction, unless you request deletion sooner.
  • Transaction and billing records: Retained for 7 years to comply with financial and tax legal obligations.
  • Marketing consent records: Retained for 5 years from the date of consent, or until withdrawn.
  • Cookie consent logs: Retained for 12 months as required by applicable consentmanagement regulations.
  • Job application data: Retained for 12 months after the position is filled, unless you consent to retention for future opportunities.

When personal information is no longer needed, we securely delete or anonymize it. Anonymized data may be retained indefinitely for research and statistical purposes.

10. DATA SECURITY

We implement appropriate technical and organizational security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. Our security measures include:

  • Encryption of data in transit using TLS/HTTPS
  • Encryption of data at rest using AES-256 or equivalent standards
  • Access controls based on the principle of least privilege
  • Regular security assessments and penetration testing
  • Employee training on data protection and security awareness
  • Incident response procedures and breach notification processes

No method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your personal information, we cannot guarantee absolute security. If you believe your account has been compromised, please contact us immediately at media@climate.ai.

11. YOUR RIGHTS – EEA, UK, AND SWITZERLAND (GDPR)

If you are located in the EEA, UK, or Switzerland, you have the following rights under the GDPR and applicable data protection laws:

  • Right of Access (Article 15): You have the right to request a copy of the personal data we hold about you and information about how we process it.
  • Right to Rectification (Article 16): You have the right to request correction of inaccurate or incomplete personal data.
  • Right to Erasure / ‘Right to be Forgotten’ (Article 17): You have the right to request deletion of your personal data, subject to certain exceptions (e.g., where we are required to retain data by law).
  • Right to Restriction of Processing (Article 18): You have the right to request that we restrict how we process your data in certain circumstances.
  • Right to Data Portability (Article 20): You have the right to receive your personal data in a structured, commonly used, machine-readable format and to transmit it to another controller.
  • Right to Object (Article 21): You have the right to object to processing based on legitimate interests or for direct marketing purposes. Where you object to marketing, we will stop immediately.
  • Rights Related to Automated Decision-Making (Article 22): You have the right not to be subject to solely automated decisions that produce legal or similarly significant effects. ClimateAi does not currently engage in fully automated decision-making that significantly affects individuals.
  • Right to Withdraw Consent (Article 7(3)): Where processing is based on consent, you have the right to withdraw your consent at any time, without affecting the lawfulness of processing prior to withdrawal.

To exercise any of these rights, please submit a request to media@climate.ai or our Data Protection contact listed in Section 14. We will respond within 30 days (or up to 3 months for complex requests, with notice).

You also have the right to lodge a complaint with your local supervisory authority. In the EU, this is your national Data Protection Authority (DPA). In the UK, this is the Information Commissioner’s Office (ICO) at ico.org.uk. In Switzerland, this is the Federal Data Protection and Information Commissioner (FDPIC) at edoeb.admin.ch.

12. CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)

If you are a California resident, this section applies to you in addition to the rest of this Privacy Policy. It describes our practices under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA).

12.1 Categories of Personal Information Collected

In the preceding 12 months, we have collected the following categories of personal information about California consumers:

  • Identifiers: Name, email address, IP address, account username, and similar identifiers.
  • California Customer Records: Phone number, employment information, and company name.
  • Internet or Electronic Network Activity: Browsing history on our site, search queries, page interactions, and cookie-based identifiers.
  • Geolocation Data: Approximate geolocation derived from IP address (not precise GPS location).
  • Professional or Employment-Related Information: Job title, company, and industry provided by users or enriched from third-party sources.
  • Inferences: Profiles drawn from usage patterns to understand user preferences and interests for product improvement purposes.
12.2 Purposes for Collection

We collect the categories of personal information listed above for the business purposes described in Section 5 of this policy, including providing our Services, analytics, security, and communications.


12.3 Sharing and Selling

ClimateAi does not sell personal information for money. However, certain sharing of personal information with advertising partners (e.g., via marketing cookies) may constitute “sharing” under the CPRA for cross-context behavioral advertising purposes. You have the right to opt out of such sharing.


12.4 Your California Privacy Rights

As a California resident, you have the following rights:

  • Right to Know: You have the right to request disclosure of the categories and specific pieces of personal information we have collected about you, the sources, the business or commercial purposes, and the categories of third parties with whom we share information. This right covers the preceding 12 months.
  • Right to Delete: You have the right to request deletion of personal information we have collected about you, subject to certain exceptions.
  • Right to Correct: You have the right to request correction of inaccurate personal information we maintain about you.
  • Right to Opt Out of Sale or Sharing: You have the right to opt out of the sale or sharing of your personal information for cross-context behavioral advertising. To exercise this right, click the “Do Not Sell or Share My Personal Information” link in our website footer, or enable the Global Privacy Control (GPC) in your browser.
  • Right to Limit Use of Sensitive Personal Information: To the extent we collect sensitive personal information (as defined by the CPRA), you have the right to limit its use to what is necessary to provide the Services. Click the “Limit the Use of My Sensitive Personal Information” link in our footer to exercise this right.
  • Right to Non-Discrimination: We will not discriminate against you for exercising your California privacy rights. We will not deny you goods or services, charge different prices, or provide a different quality of service because you exercised a right under the CCPA/CPRA.
12.5 How to Submit a California Privacy Request

To exercise your California rights, you may:

  • Email us at media@climate.ai with the subject line “California Privacy Request”
  • Submit a request through our website at climate.ai/privacy-request

We will verify your identity before processing your request and respond within 45 days. We may extend this period by an additional 45 days where reasonably necessary, with notice. We will provide responses free of charge, unless requests are manifestly unfounded or excessive.


12.6 Authorized Agents

You may designate an authorized agent to submit a request on your behalf. The agent must provide written authorization signed by you, and we may verify your identity directly.


12.7 Financial Incentives

ClimateAi does not offer financial incentives in exchange for the collection, sale, or deletion of personal information.

13. AUTOMATED DECISION-MAKING AND AI

ClimateAi’s core product involves AI and machine learning models that generate climate forecasts and business insights. These models process environmental, geographic, and agricultural data — not personal data — to produce predictions.

ClimateAi does not use personal information to make automated decisions that produce legal or similarly significant effects on individuals. If this changes, we will update this policy and provide required notices.

14. CHILDREN’S PRIVACY

Our Services are directed to businesses and professionals and are not intended for individuals under 16 years of age. We do not knowingly collect personal information from children under 16. If we discover that a child under 16 has provided personal information, we will promptly delete it. If you believe a child has submitted information to us, please contact us at media@climate.ai.

15. THIRD-PARTY LINKS AND INTEGRATIONS

Our website and Services may contain links to third-party websites, integrations, or embedded content. This Privacy Policy does not apply to those third-party sites. We encourage you to review the privacy policies of any third-party services you access through our platform.

17. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational or business reasons. When we make material changes, we will notify you by:

  • Posting the updated policy on our website with a new “Last Updated” date
  • Sending an email notification to registered users (for significant changes)
  • Displaying a prominent notice on our website or within the platform
